After Dhaka garment factory collapse, chances for supply chain changes low

A factory collapse in Bangladesh left some 300 dead, and prompted calls for improved regulations of the country's sweatshops. But veteran campaigners to improve factory conditions say pushing for change is harder than ever.?

As Bangladeshi rescue workers continue to pull survivors and bodies from the ruins of a Dhaka, Bangladesh factory where some 300 were killed in a building collapse Wednesday, thousands of protesters took to the streets across the city to express their outrage at?negligence that has racked the world's second-largest garment-exporting country for years.

Blocking traffic and vandalizing garment factories that stayed open during today?s official day of mourning, protestors smashed cars and clashed violently with police, demanding accountability for what The New York Times is calling ?one of the worst manufacturing disasters in history.?

Among those at the receiving end of the rage are not only unscrupulous local factory owners and lax regulators, but also the Western corporations whose demands for cheaply-made garments have fueled the precarious working conditions in Bangladesh?s 5,000 clothing factories.

Plucked from the rubble of the eight-story factory were labels from several Western brands, including some sold in major chains such as Wal-Mart, JC Penney, and Spanish retailer El Corte Ingles, who immediately began to issue a flurry of sympathetic press releases. British retailer Primark said it was ?shocked and deeply saddened by this appalling incident? and the Canadian retailer Loblaw said it was ?extremely saddened? by the tragedy, the Times reports.

None, however, went so far as to implicate themselves in the disaster.

?These companies have come up with some very effective approaches to distance themselves from responsibility in tragedies like this,? says Heather White, founder of Verite, an independent auditing group.?Indeed, she says, Western companies often bring their garments from factory to store through a tangled and globally sprawled cluster of middlemen ? subcontractors, auditors, consultants ? who not only drive down their prices but also help ensure that responsibility for corporate stumbles are spread thinly.

That leaves many Western consumers, even the most conscientious, flummoxed by how to react to tragedies like the factory collapse, Ms. White says. Short of switching to niche-marketed fair trade brands?think American Apparel or TOMS Shoes ? there?s ?no real way for your average consumer to use their buying power to mobilize around these issues,? she says.

But it wasn?t always that way.

In the late 1990s, a widespread campaign against labor conditions in Nike factories helped shame the company into adopting a code of conduct in its factories for the first time. Responding to massive protests, sit-ins, and hunger strikes, a large number of universities forced the suppliers of their branded athletic apparel to institute labor code reforms in return for their business.

?It was amazing to see how people bought in [to the campaign],? remembers Kirsten Moller, organizing director for the human rights group Global Exchange, which helped lead the Nike campaign. ?They really had no idea what was happening, no idea under what conditions these products they loved were being made.?

So what changed?

As the issue slid from the front page, "people got tired of protesting,? Ms. Moller says.

Many of the activists from the 1990s ? immortalized by their chaotic protests at the 1999 summit of the World Trade Organization ? moved on to new causes, White says, with many becoming deeply involved in anti-war efforts in the early 2000s.?

And perhaps more importantly, the corporations simply caught up. ?They co-opted the language of human rights and social responsibility,? she says, ?because they realized their consumers now cared about that.?

As a result of the Nike movement, she says, most corporations now at least pay lip service to the idea that transnational companies have a responsibility to the people who work for them and the land they work on.

?But we?re nowhere near where we should be,? she says.

In the streets of Dhaka today, it seems there are many who would agree with that.?

Celts top Knicks 97-90 in OT, avoid playoff sweep

BOSTON (AP) ? Jason Terry scored Boston's last nine points and the Celtics weathered a strong comeback by the New York Knicks, avoiding a sweep with a 97-90 overtime win on Sunday.

Paul Pierce led the Celtics with 29 points as they forced a fifth game in the series, but it was Terry who provided the finishing touches.

In Game 3, he had been elbowed by J.R. Smith, and the NBA suspended the Knicks guard for Sunday's game.

New York had tied the game 84-84 after trailing by 20 points early in the third quarter. It was 88-all before the Celtics regained control and took the lead for good on a 3-pointer by Terry. Carmelo Anthony, who led the Knicks with 36 points, hit a short jumper, but Terry connected on a 15-footer with 50 seconds remaining for a 93-90 lead.

After Anthony missed a 3-pointer with 21 seconds to go, Terry was fouled and sank both free throws. He added a layup to close out the game.

But the Celtics still have a huge deficit in trying to become the first team to win after trailing a series 3-0.

Game 5 is Wednesday night in New York, where the Knicks can win their first playoff series in 13 years.

Jeff Green scored 26 points for the Celtics and Terry finished with 18.

The Celtics showed renewed energy early after being held below 80 points in each of the first three games. They led 54-35 at halftime and 59-39 three minutes into the third quarter before their recent second-half woes returned. In previous first halves, they scored just 25 points in Game 1 and 23 in Game 2. On Sunday, they were outscored 30-14 in the third quarter and led just 68-65 heading into the fourth.

Boston held a 65-51 lead when Anthony went to the bench with 3:35 remaining. The Knicks outscored the Celtics 14-3 the rest of the way behind 11 points from Felton and a 3-pointer from Iman Shumpert. Felton finished with 16 points in the quarter and 27 in the game.

The Knicks played the first half as if they had taken shooting lessons from the Celtics. New York hit just 28.9 percent of its shots (11 for 38) after Boston made only 39.5 percent of its attempts in the first three games.

The Celtics found their range from the start and connected on 51.3 percent (20 for 39).

Notes: The Knicks were 19-2 in their previous 21 games. The Celtics were 5-14 in their previous 19. ... For the Celtics, Garnett, Green and Brandon Bass each had four fouls five minutes into the third quarter. Bass committed his fifth with 5:10 left in the period and fouled out with 4:27 to go in the games. ... Anthony committed his fourth with 4:08 remaining in the third.

New York drops damages claim in suit against ex-AIG chief

NEW YORK (Reuters) - New York's attorney general is dropping a claim for damages in a high-profile civil lawsuit accusing the former chief executive of American International Group Inc, Maurice "Hank" Greenberg, of defrauding investors, according to a letter sent by the attorney general's office on Thursday.

The 2005 lawsuit filed by then-Attorney General Eliot Spitzer against Greenberg and former AIG chief financial officer Howard Smith sought as much as $6 billion in damages.

In an April 25 letter to the New York Court of Appeals, New York Solicitor General Barbara Underwood wrote that the state would still be pursuing the civil fraud case against the defendants but would not be seeking damages, in order "to avoid further delay and expedite the trial of the state action."

The office will continue to pursue other remedies against the defendants, including a potential ban on working in the securities industry or serving as an officer or director of a public company, the letter said.

"Attorney General (Eric) Schneiderman feels strongly that individuals in the financial services industry who perpetrate fraud, no matter how wealthy or powerful, must be held publicly accountable, and that is why we believe justice will best be served by proceeding to a long overdue trial of Mr. Greenberg as quickly as possible," New York attorney general spokesman Damien LaVera said in a statement.

A lawyer for Greenberg, David Boies of Boies Schiller & Flexner, said in a statement that the action "finally brings down the curtain on a series of issues of claims that were never justified and should never have been brought in the first place."

The decision to withdraw the claim for damages in state courts follows an April 10 order approving a $115 million settlement reached by AIG shareholders with Greenberg and other defendants over alleged accounting improprieties at the insurance giant.

Lawyers for Greenberg argued that the $115 million settlement in federal court would effectively preclude Schneiderman from seeking "duplicative damages" from Greenberg in state court.

The attorney general's lawsuit centered around two reinsurance transactions in 1999 and 2000. It was brought under the Martin Act, a law that allows New York's top state prosecutor to pursue criminal or civil fraud cases involving suspected corporate wrongdoing.

The case is currently pending before the New York Court of Appeals, the state's highest court.

The case is People v. Greenberg et al, Supreme Court of the State of New York, New York County, No. 401720/05.

The world competition winners for narrative and documentary films were chosen from 12 narrative and 12 documentary features from 14 countries. Looking for life by the light of dying stars

Apr. 24, 2013 ? Because it has no source of energy, a dead star -- known as a white dwarf -- will eventually cool down and fade away. But circumstantial evidence suggests that white dwarfs can still support habitable planets, says Prof. Dan Maoz of Tel Aviv University's School of Physics and Astronomy.

Now Prof. Maoz and Prof. Avi Loeb, Director of Harvard University's Institute for Theory and Computation and a Sackler Professor by Special Appointment at TAU, have shown that, using advanced technology to become available within the next decade, it should be possible to detect biomarkers surrounding these planets -- including oxygen and methane -- that indicate the presence of life.

Published in the Monthly Notices of the Royal Astronomical Society, the researchers' "simulated spectrum" demonstrates that the James Webb Space Telescope (JWST), set to be launched by NASA in 2018, will be capable of detecting oxygen and water in the atmosphere of an Earth-like planet orbiting a white dwarf after only a few hours of observation time -- much more easily than for an Earth-like planet orbiting a sun-like star.

Their collaboration is made possible by the Harvard TAU Astronomy Initiative, recently endowed by Dr. Raymond and Beverly Sackler.

Faint light, clear signals

"In the quest for extraterrestrial biological signatures, the first stars we study should be white dwarfs," said Prof. Loeb. Prof. Maoz agrees, noting that if "all the conditions are right, we'll be able to detect signs of life" on planets orbiting white dwarf stars using the much-anticipated JWST.

An abundance of heavy elements already observed on the surface of white dwarfs suggest rocky planets orbit a significant fraction of them. The researchers estimate that a survey of 500 of the closest white dwarfs could spot one or more habitable planets.

The unique characteristics of white dwarfs could make these planets easier to spot than planets orbiting normal stars, the researchers have shown. Their atmospheres can be detected and analyzed when a star dims as an orbiting planet crosses in front of it. As the background starlight shines through the planet's atmosphere, elements in the atmosphere will absorb some of the starlight, leaving chemical clues of their presence -- clues that can then be detected from the JWST.

When an Earth-like planet orbits a normal star, "the difficulty lies in the extreme faintness of the signal, which is hidden in the glare of the 'parent' star," Prof. Maoz says. "The novelty of our idea is that, if the parent star is a white dwarf, whose size is comparable to that of an Earth-sized planet, that glare is greatly reduced, and we can now realistically contemplate seeing the oxygen biomarker."

In order to estimate the kind of data that the JWST will be able to see, the researchers created a "synthetic spectrum," which replicates that of an inhabited planet similar to Earth orbiting a white dwarf. They demonstrated that the telescope should be able to pick up signs of oxygen and water, if they exist on the planet.

A critical sign of life

The presence of oxygen biomarkers would be the most critical signal of the presence of life on extraterrestrial planets. Earth's atmosphere, for example, is 21 percent oxygen, and this is entirely produced by our planet's plant life as a result of photosynthesis. Without the existence of plants, an atmosphere would be entirely devoid of oxygen.

The JWST will be ideal for hunting out signs of life on extraterrestrial planets because it is designed to look into the infrared region of the light spectrum, where such biomarkers are prominent. In addition, as a space-based telescope, it will be able to analyze the atmospheres of Earth-like planets outside our solar system without weeding out the similar signatures of Earth's own atmosphere.

Smartphones Are Dominating At AT&T

att-logoAT&T just released its first-quarter financial statement. Things are looking good at Ma Bell where profits are up although revenue missed expectations. The company managed to get more consumers to sign long-term wireless contracts, and best of all, wireless margins increased on the back of smartphone sales where they accounted for 88% of the company’s sales in the quarter. In short, smartphones are ringing in the money for AT&T. AT&T has long sought after the best smartphones. From the iPhone to the original Lumia 900, and most recently, to the HTC First, AT&T seemingly strives to have the latest and greatest smartphones. I’ve often criticized this strategy, pointing to these exclusives when devices fail to capture a large market share. While the limited release might hurt the device’s sales, AT&T clearly isn’t suffering. With this quarter’s numbers in the ledger, 72 percent, or 48.3 million, of AT&T’s postpaid phone subscribers owned smartphones, up from 61 percent, or 41.2 million, a year earlier. AT&T sold 6 million smartphones during the first quarter, which is a record and even more impressive considering there wasn’t a major smartphone release during that time. As AT&T continues to hone its game, wireless margins grew driven by improved operating efficiencies and further revenue gains from the company’s lucrative smartphone subscribers. Its first-quarter wireless operating income margin was 28.0 percent versus 27.8 percent in the year-earlier quarter.

Skin Cancer Linked to Higher Risk of Other Cancers

People who have had common skin cancers may be at an increased risk of getting cancer again in their life, according to a new study.

The study found that women with nonmelanoma skin cancers (such as basal cell carcinoma or squamous cell carcinoma) were 26 percent more likely to later develop another form of cancer, compared with women who didn't have these skin cancers. In men, the risk increased by 15 percent, the study found.

The study included more than 150,000 people who were followed for more than 20 years, so the findings strongly add to the growing evidence of a link between skin cancer and later development of other cancers, said Anthony Alberg, a professor of epidemiology at the Medical University of South Carolina.

The increased risk of cancer seen in the study isn't high enough to warrant recommending that people with nonmelanoma skin cancers undergo cancer screening tests earlier or more often than generally recommended, said Alberg, who was not involved in the new study. It does, however, raise the question of whether more screening might be beneficial for this group, and future studies might look at this, he said.

Nonmelanoma skin cancers are "so common we can't even count them," so the findings have public health significance, Alberg said. A 2006 study showed there were 2.1 million cases of non-melanoma skin cancer in the U.S.

The link may also help researchers to better understand cancer biology, he said.

The new study is published today (April 23) in the journal PLOS Medicine.

How cancer risk increases

For the study, researchers led by Jiali Han, an associate professor of dermatology at Harvard Medical School, looked at cancers among people participating in two large studies ? the Health Professionals Study, which began in 1986, and the Nurses' Health Study, which began in 1984. By 2008, about 29,500 cases of cancer had been diagnosedin the 153,600 people in these studies.

Results showed that people with nonmelanoma skin cancer were at an increased risk of developing the deadly skin cancer melanoma, and that women with nonmelanoma skin cancer were at increased risk of lung cancer and breast cancer, according to the study. The researchers accounted for factors that could affect the results, such as people's ages, smoking, and for women, the use of hormone replacement therapy.

Alberg said that previous studies have linked common skin cancers with an increased risk of other types of cancers. In the new study, there was increased risk of other types of cancer as well, but these increases did not rise to the level of statistical significance. Still, the fact that 23 out of 28 cancer sites examined were trending toward an increased risk means there is likely something underlying the links, he said.

"The increase really doesn't map well with any specific cancer? there's more of a general increase in cancer risk," he said.

Why the link?

The link between nonmelanoma skin cancers and developing melanoma later may be due to sun exposure, the researchers said.

But the reason for the general increased risk of other cancers is unclear. Some researchers suspect that the cellular machinery involved in DNA repair may not work as well in some people, leaving them at an increased risk for any type of cancer, Alberg said.

By studying people who have developed more than one type of cancer, a situation called "multiple primary cancers," researchers can develop a better understanding of cancer biology, he said. The skin cancers in the study are common, and unlike other primary cancers, they are not typically treated with radiation or chemotherapy, both of which have been linked to increased cancer risk later on.

"Looking at these cases, we might really be able to find what causes these risks," Alberg said.

With the NFL Draft approaching, we?re taking a team-by-team look at the needs of each club. Up next is the team with the No. 30 overall selection, the Atlanta Falcons. They have a total of 11 picks, and aren?t afraid to make bold moves, so their picking somewhere north of 30 is a real possibility.

Defensive end: There?s already noise about the Falcons wanting to move up in the order, and it makes sense that their target would be a pass-rusher.

John Abraham was still producing right up until the time they released him, and they have to find someone to replace that production other than Osi Umenyiora, who has not produced at the same consistent level. If they can get into the top half of the first round, they can find someone in the Abraham mold, before the run starts.

Cornerback: This would be the other drastic need that could be the target for a move-up. It seems like forever ago they were three-deep with excellent players. But with Brent Grimes gone to Miami and and Dunta Robinson released and resurfaced in KC, they?re down to Asante Samuel and a bunch of guys.

Linebacker: You could probably run down the list of defensive positions, and the Falcons could stand to upgrade. Sean Weatherspoon is quite good, but the rest of their linebacking corps is fairly ordinary.

Tackle: The thinking is the release of Tyson Clabo opened the door for Lamar Holmes to start at right tackle, and that could work. But they still need cover here, particularly if newly rich left tackle Sam Baker goes back to the 2011 version instead of the 2012 salary-push version.

Guard: The retirement of Todd McClure leaves a big hole, but they could slide 2012 second-rounder Peter Konz over from right guard. But that leaves another vacancy. They have some in-house candidates, but need depth here.

As good as they are, they?re not as well-covered as you?d think. They have nothing to speak of in terms of depth on defense. Heck, they don?t even have a full complement of starting-caliber players on that side of the ball.

But their offensive skill-position talent is so good, it might not matter. As long as Matt Ryan, Steven Jackson, Julio Jones, Roddy White and Tony Gonzalez are together, the Falcons are going to be among the best in the NFC.

But until they get at least a little bit better on defense, it?s going to be hard for them to make the next step.

Their offseason efforts have focused on retaining their own, and making a few surgical signings of veterans who came looking for rings. Their team is good enough that 11 draft picks aren?t making their 53-man roster, so they might as well make some moves, and see if they can plug some starters in on defense.
